These Terms of Service (“Terms”) govern your use of www.westendbd.com (the “Site”) and any purchase you make from it. The Site is operated by WIRECUT INC., trading as WESTEND (“we”, “us”, “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

WESTEND is a trading name of WIRECUT INC. All contracts for the sale of goods described on this Site are made with WIRECUT INC., which holds its registered office in New York, United States, and operates its studio, production and dispatch from Dhaka, Bangladesh. Both addresses are given at the foot of this page.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, and legally able to enter into a binding contract, in order to place an order.

3. Products, descriptions and imagery

We describe our products as accurately as we can, including fibre content and country of manufacture. All goods described on this Site are made in Bangladesh.

Photography on this Site includes campaign and editorial imagery that is representative of the collection's styling and is not always a photograph of the exact item you will receive. Colours can also vary between screens. If the precise appearance of a piece matters to you, ask us for additional photographs before you order and we will send them.

Sizes are cut to the measurements published in our size guide. Products are produced in limited runs, and availability is not guaranteed until we confirm your order in writing.

4. Prices and payment

• Prices are quoted in the currency stated in your order confirmation and include applicable taxes where we are required to charge them.
• Shipping costs are quoted separately and in full before you confirm payment.
• Import duties and destination taxes on international orders are your responsibility, as set out in our Shipping policy.
• We may change prices at any time, but a change will never affect an order we have already confirmed.

If a price or product description is obviously wrong — a clear pricing error — we may cancel the affected order and refund you in full rather than fulfil it at that price. We will tell you promptly if this happens.

5. How a contract is formed

Placing an order is an offer to buy. A contract is formed only when we send you a dispatch confirmation, or a written production confirmation for a made-to-order piece. We may decline an order where the item is unavailable, where we cannot verify payment or delivery details, or where we reasonably suspect fraud.

6. Delivery, returns and refunds

Delivery times, shipping origin, customs and duties, the 14-day return window, exclusions and refund timescales are set out in our Shipping, Returns and Refunds policy, which forms part of these Terms. Nothing in these Terms limits your statutory rights in respect of goods that are faulty, not as described or not fit for purpose.

7. Acceptable use

You agree not to use the Site to: break any law; infringe anyone's rights; introduce malware or attempt to gain unauthorised access; scrape, mirror or systematically extract content; place fraudulent or speculative orders; or interfere with the Site's operation or security.

8. Intellectual property

The WESTEND name, wordmark, logo, page design, text and product designs are owned by WIRECUT INC. or used under licence, and are protected by intellectual property law. You may view and print pages for your own personal, non-commercial use. Any other reproduction, distribution or commercial use requires our prior written permission.

Photography on this Site is licensed from third-party contributors via Unsplash and remains the property of the respective photographers. It is used here under the terms of that licence and may not be extracted from the Site for separate use.

9. Third-party links and services

The Site may link to third-party websites and use third-party services such as payment processors, couriers and advertising platforms. We are not responsible for the content or practices of third-party sites. Their own terms and privacy policies will apply to your use of them.

10. Disclaimers and limitation of liability

The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free.

To the fullest extent permitted by law, WIRECUT INC. is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of the Site. Where liability cannot lawfully be excluded, our total liability in connection with any order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

11. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, and the courts of the State of New York have exclusive jurisdiction over any dispute — without prejudice to any mandatory consumer protections available to you in the country where you live, including, for customers in Bangladesh, rights under Bangladeshi consumer protection law. Before starting formal proceedings, please contact us: most issues are resolved by email within a few days.

12. Changes and contact

We may update these Terms from time to time. The version in force at the moment you place an order is the version that applies to that order. The date at the top of this page shows when these Terms were last revised.
